This Privacy Notice is entirely in line with the Regulation (EU) 2016/679 of the European Parliament and of the Council (also known as ”GDPR”). Moreover - due to recent developments - We also keep our eyes on the Swiss Act of Data Protection and the regulation concerning data transfer to the US – and if necessary, keep this text updated to comply with such rules.

The term “data controller” refers to a natural or legal person, public authority, agency, or other body that determines the purposes and means of processing personal data alone or jointly with others. In this case, we are your Data Controller
The term “personal data or data subject” refers to any information relating to an identified or identifiable natural person like you (e.g., your shoe size, Geolocation data).
The term “data processor” refers to any natural or legal person, public authority, agency, or other body which processes personal data on behalf of 3D Agora. (3) Type of personal data we process:

General Data - To operate 3D Agora, we have to identify you
Financial Data - In case you become a User, you may pay for our 3D Artist services
Location Data - It matters where you are since it has an impact on who will be your 3D Artist
Marketing Data - It helps us keep your attention on our services

(4) Origin of the personal data we receive:

As a Client and 3D Artist, you submit data that will later turn into project collaborations after accepting 3D Agora’s General Terms of Conditions (abbrev. “GTC”).
Your Activities - we process data that contains information about your activities on our page.
Other Parties - we process data that other parties - for example, online service providers like Stripe.com - shared with us as part of service agreements about payments or Marketing Data that social media service companies like Instagram offer us as part of third-party service agreements.

(5) Purpose of Data Processing

We offer a stand-alone Service to you as elaborated in GTC - in line with GDPR Art. 6 (1) b). Important to note that we do not share your personal data with anyone other than Clients and 3D Artists.

We improve the quality of our services in line with GDPR Art. 6 (1) and f). In this case, we carefully consider any data processing in line with the LIA – Legitimate Interest Test.

The data (including personal data) submitted by the Clients or by 3D Artists will be processed by the employees of 3D Agora. Every employee and sub-contractor (data processor) is under strict confidentiality rules by signing confidentiality statements and using up-to-date encryption technologies. As a matter of principle, 3D Agora follows the principles of privacy by default and privacy by design. We carefully selected subcontractors (data processors) who are compliant with GDPR requirements in their business conduct.

(10) Data Transfers to Countries beyond EU and EEA

3D Agora does not intend to transfer personal data to a third country or international organization without prior consent and notification to its users. 3D Agora carefully and regularly examines service providers and related developments applicable to the European Union's legal frameworks by abiding by the Privacy by Default principle. We are aware of and actively use suitable safeguards, including adequacy decisions and Standard Contractual Clauses (SCCs) issued by the EU Institutions.

(11) Time limitations in storing/processing data

3D Agora ensures fair and transparent processing and stores your information until using our services. Upon deletion request or if you decide not to use our services further on, please consider that certain types of data had to be stored based on legal requirements (for example, required by the national tax authority ) or stipulations in civil laws and regulations.

(12) Your Rights

The Data Controller is committed to the principle of data minimization so that only adequate, relevant, and limited data are collected, only for necessary reasons and for the purposes for which they are processed.

Deletion of your personal data.
In cases when you gave us consent on specific data processing (see section 8), you also have the right to withdraw your consent. You may note that this right can be exercised without impacting the lawfulness of processing based on the consent before its withdrawal.

(13) Provision of Data

Please note that 3D Agora services shall not be available if you fail to provide necessary personal data. If you provide inappropriate or corrupted data, the Controller shall be entitled to, upon your notification, delete the previously submitted data that may require re-registration on the website.

(14) Automated decision-making, including profiling

3D Agora currently does not implement or apply automated decision-making or profiling. All data that is processed is under human control and revision. If AI or related Algorithm-based products are introduced in the future, 3D Agora shall notify its Clients and 3D Artists promptly.

(15) Purpose limitation

3D Agora has not, is not, and will not plan to further process the personal data for purposes other than that they were collected.

(16) Complaint and Information on Data Protection Authorities and Legal Remedies

If you are not satisfied with our response and seek legal remedies, you have the right to complain to the competent supervisory authority. 3DAgora.com is currently located in Hungary; therefore, your complaint may be sent to the National Authority for Data Protection and Freedom of Information.
